Daily Report: A Legal Battle Over a Twitter User's Identity - NYTimes ...

Twitter once again finds itself at the center of a conflict over the right to anonymity on the Web, this time in a case involving a sympathizer with the Boston offshoot of the Occupy Wall Street movement.

The Boston Globe reports that in a court hearing on Thursday in Boston, a lawyer working on behalf of the American Civil Liberties Union of Massachusetts will attempt to have a subpoena issued to Twitter quashed on First Amendment grounds. The police in Boston and the Suffolk County district attorney issued the subpoena in an effort to get information about the Twitter account @P0isAn0N and other activity on the social network related to the Occupy Boston protests. The owner of the @P0isAn0N account had also linked to personal information about Boston police officers that had been stolen in a hacking attack.

Twitter has been a strong defender of its users? rights to protect their anonymity, a stance that puts it in conflict with others who say the Web would be a better place if anonymity was discouraged or disallowed. Last month the company lost a fight to withhold information about three users who were supporters of WikiLeaks.

ReadWriteWeb reported on Tuesday that in the Boston case, Twitter apparently ignored the authorities? request that it keep the existence of the subpoena a secret. A link to a copy of the subpoena was posted by @P0isAn0N, which taunted the Boston police about it. A Twitter spokesman said it was company policy ?to notify our users about law enforcement and governmental requests for their information, unless we are prevented by law from doing so.?

The authorities in Boston face a challenge on another level. As BoingBoing pointed out, the subpoena appears to have been drawn up by someone who is unclear on the difference between a Twitter account and a hashtag.

Quake rattles New Zealand's Christchurch: USGS (Reuters)

(Reuters) ? An earthquake with a magnitude of 5.3 struck close to the New Zealand city of Christchurch on Saturday, the U.S. Geological Survey reported, but there were no immediate reports of damage or casualties.

The quake was measured only about 14 km (9 miles) northeast of the city. It was another in a series of quakes that have rattled the city since a major earthquake killed almost 200 people there 10 months ago.

There were no immediate reports of a tsunami warning.

A quake of a similar magnitude was felt in the area on December 23, sending terrified residents from their houses but causing no casualties or major damage.

Christchurch, the largest city in New Zealand's South Island, is still recovering from a quake measuring 6.3 that killed 182 people in February and caused up to NZ$20 billion ($15.5 billion) in damage.

Large areas of Christchurch's business district are still off limits after the February quake, which toppled the city's famous cathedral, as well as shops, office buildings and homes.

New Zealand straddles the boundaries of the Indo-Australian and the Pacific tectonic plates and is hit by about 14,000 quakes every year, of which only a small number top a magnitude of 5.

Five men break into Texas home dressed as Police officers

Five men dressed as police officers broke into a townhome near downtown Houston and violently robbed the homeowner.

Officials said the crooks wore Houston Police Department raid jackets, carried guns and tasers, and had fake badges when they kicked down the door of the home in the 1800 block of Wheeler at Chartres shortly after noon Monday, Dec. 26.

The suspects beat up the homeowner before tying him up and ransacking the house, police said.

A responding officer at first thought the men were real officers, but then became suspicious when he saw their suburban, officials said.

The men took off when the officer began questioning them.

Two of the suspects were apprehended with the help of police dogs.

Lee Brown Jr., 30, and Kevin Williams, 26, have been charged with Aggravated Robbery with a Deadly Weapon.

Presidential buzz surrounds leading figure of Russia's protest movement

Alexei Navalny, a vocal critic of Putin and leader in Russia's protest movement, could pose a tough threat to his presidential bid.

Russian blogger-cum-folk-hero Alexei Navalny, who is already being discussed as a potential contender to challenge Vladimir Putin in upcoming presidential polls, was released from a Moscow prison Wednesday to the wild cheers of supporters.

Mr. Navalny, whose trenchant and well-documented attacks on Kremlin corruption?have migrated from the Internet to the streets in recent weeks, was arrested and sentenced to 15 days in prison after he took part in an unsanctioned rally to protest alleged vote-rigging in Russia's Dec. 4 parliamentary election.

"These 15 days have taught me not to be afraid. I am not alone. We are the majority," he told a jubilant crowd of supporters.?"I was imprisoned in one country and am being released into another," he added.

He pledged "extraordinary efforts" to build momentum in the protest movement, which saw at least 30,000 mostly young and middle class demonstrators rally on Moscow's Bolotnaya Square on Dec. 10 to demand that the allegedly fraud-tainted elections be cancelled and re-staged under fair rules and conditions.

The next rally is set for this Saturday in Moscow, and well over 30,000 people have already signed a Facebook-based pledge to attend. Russian authorities have permitted the rally, but given?covert police actions aimed at discrediting leaders and splitting the movement, they may be extremely worried that the protests could become a real threat to Kremlin dominance.

Navalny is the author of the term "party of rogues and thieves" to describe Mr. Putin's ruling United Russia party (UR), a phrase that went viral in Russia and may have contributed as much as any other factor to UR's massive loss of support in the election.

Even with what critics estimate as up to 20 percent fraudulent boost in its vote tally, UR barely managed to eke out a 50 percent victory in the polls.

After the New Year break, Russia will launch into presidential polls that will see Putin face off against handful of drearily familiar, lackluster opponents, including Communist Party leader Gennady Zyuganov, ultranationalist Vladimir Zhirinovsky and liberal Yabloko chief Grigory Yavlinsky ? most of whom?have been defeated repeatedly in set-piece elections by Putin.?

A new contender is tycoon Mikhail Prokhorov,?who announced his candidacy last week in the wake of the massive Moscow protest. But few think Mr. Prokhorov, a superwealthy "oligarch" who gained his fortune through murky wheeling-and-dealing in the wild 1990s, can attract any votes beyond Russia's narrow business and emerging professional elites.

Many experts say Navalny, with his street cred and reputation as a democratic nationalist, could be the candidate to appeal beyond the confines of downtown Moscow and pose a genuine challenge in Putin's vast provincial and working class base ? if he were allowed to run.

"I think Navalny is the leader of the future," says Konstantin Bakulev, director of the independent Institute of Socio-Economic Modernization in Moscow. "He has all the right things going for him: he's a new face, not linked to any of the old-line political parties, and he's really trending right now. People say he's a nationalist, but he's really a patriot. If he proves he can work with people, he will go places."

Upon his release Wednesday morning, Navalny fueled speculation about a possible presidential run by aiming a sharp rhetorical barb at Putin personally.

"The party of rogues and thieves is putting forward its chief rogue and its top thief to run for the presidency," Navalny said. "We must vote against him, struggle against him."

Remember CUPP Computing's PunkThis board we played with at Computex 2011? It's now left the confines of its 2.5-inch hard drive form-factor and jumped ship from a standard Asus netbook to a Core i5-equipped Eee Slate EP121, taking residence alongside the tablet's battery. As a refresher, PunkThis puts a complete ARM-based system into an x86 computer by replacing the SATA HDD with a single core 1GHz Texas Instruments OMAP 3730 processor, 512MB RAM and WiFi, along with a mini-PCie socket for SSD storage, plus connectors for the hosts video, audio and USB interfaces. While CUPP computing is still working hard to make PunkThis commercially available for tech-savvy individuals, it acquired Israeli security company Yoggie last July and built this demo machine to attract another kind of customer.

The tablet we tested was running Windows 7 Home Premium and Android 2.3.4 simultaneously, and was equipped with an additional button for switching between x86 and ARM modes. Leafs coach Ron Wilson gets contract extension

? Maple Leafs coach Ron Wilson has gotten his Christmas wish.

Two days after hinting on Twitter of his desire for a new contract, Wilson says the team has given him an extension.

"'He came! He came!' Remember saying that as a little kid? Well he did: I got a new Red Ryder BB gun and a contract extension!" Wilson tweeted Sunday morning.

The team did not immediately respond to an email seeking confirmation. Wilson tweeted Friday that what he wanted for Christmas was a new contract from general manager Brian Burke.

"This Xmas could be better if Santa stuffs a certain piece of paper in my stocking. whatcouldthatbe," Wilson posted on his Twitter account.

The 56-year-old Wilson is in the final season of a four-year contract. The Leafs are sixth in the Eastern Conference with 40 points. Toronto has not made the playoffs in three previously seasons under Wilson, who is 119-120-42 with the Leafs.

Wilson, a defenseman as a player, was selected by the Leafs in the 1975 draft. He has a 637-546-101-88 coaching record with Anaheim, Washington, San Jose and Toronto. He is 47-48 in the playoffs.

Chambliss gives Washington wrap-up in Moultrie

MOULTRIE, GA -- U.S. Sen. Saxby Chambliss (R-Georgia) began his Washington wrap-up during a visit to Moultrie on Thursday by?bluntly saying, "Things are a mess."

?We have been a pretty dysfunctional Congress and I don?t know what we can do about? it,? he says.

Chambliss says money has been on the minds of Americans and is so especially during the holiday season; particularly when it comes to the payroll tax cut debate.

?To think that their payroll check is going to diminish come Jan. 1 is not something anyone is looking forward to,? he says.

On Thursday, House Speaker John Boehner agreed to a two-month extension of the payroll tax cuts. The two-month extension Chambliss says is a temporary fix.

?There are ways to make this happen, and I think this is the right thing to do right now; long term it probably is not. We need to see a reduction in spending on the other side of the ledger this year to replace that money in the Social Security Trust Fund and there are no plans out there to do that,? he says.

Another point of discussion for Chambliss was the nation?s $15 trillion debt. He says it will take a lot of sacrifices from everyone in three specific areas: federal spending, entitlement program reform and broadening the tax base.

?We need to reduce federal spending. It?s way out of control. Unfortunately if you cut out all federal spending it would not fix the problem,? he says.

He says this along with reforming entitlement programs like Medicare, Medicaid and social security and broadening the tax base will help get the fiscal house in order and work to repair the deficit.

"We have to figure out a way to broaden our tax base, put people back to work, energize the economy and raise revenues by doing that," says Chambliss. "In order to do that it's going to require a major overhaul of the tax code, it's going to require a major overhaul of these entitlement provisions and people are going to have less support coming from the federal government."

Chambliss says selling bonds to assist the U.S. debt problem may turn from a solution to a problem.

?If we're going to continue to sell our bonds to people across the world, particularly the Chinese they're the largest foreign buyer of our bonds they will tell us how we're going to fix it if they're going to continue to buy our bonds and we do not need to be put in that position,? he says.

Chambliss also took time to discuss the situation in Iraq and the recent withdraw of troops. He says pulling the troops out gives free reign for the terrorists to operate as they want because the U.S. did not have sufficient time to train Iraqis.

?We were getting close but we weren?t there,? he says. Chambliss ? also the Vice Chair of the Intelligence Committee ? says he does commend the uniformed men and women for their work overseas, taking the intelligence gathered by the committee and working well with it.

Chambliss says he?s aware his ideas and opinions aren?t shared by all, but he says that?s part of the job.

?If you?re not catching flack from someone in Washington, you?re not doing your job,? he says.

Suicide attack kills 6 Pakistani soldiers (AP)

PESHAWAR, Pakistan ? A Pakistani Taliban suicide bomber rammed a car filled with explosives into a paramilitary camp in northwestern Pakistan on Saturday, killing six soldiers in the second attack in as many days meant to avenge the killing of senior commander in a U.S. drone strike.

The blast caused a part of a building to collapse inside the Frontier Corps camp, which was located in Bannu town in Khyber Pakhtunkhwa province, said local police officer Tahir Khan. At least 19 soldiers were wounded in the attack, and rescue workers were searching for additional casualties, he said.

A Pakistani Taliban spokesman, Ehsanullah Ehsan, claimed responsibility for the attack in a phone call to The Associated Press. He said it was meant to avenge the death of commander Taj Gul in a U.S. drone strike in October in the South Waziristan tribal area, a key sanctuary for the militants.

Gul was the Pakistani Taliban's operational commander in South Waziristan and was responsible for many attacks against security forces.

Around three dozen Pakistani Taliban fighters armed with assault rifles attacked a paramilitary camp in Tank district near South Waziristan before dawn Friday, killing one soldier and kidnapping 15 others.

Ehsan, the Taliban spokesman, said Friday that attack was also meant to avenge Gul's death. The militants targeted the soldiers because of Pakistan's alliance with the United States, he said.

Ehsan pledged they would kill the kidnapped troops, saying "we are going to cut these soldiers into pieces one by one, and we will send these pieces to their commanders."

The Pakistani Taliban has waged a fierce insurgency in Pakistan over the past four years, killing tens of thousands of security personnel and civilians. Their aim is to topple the civilian government, partly because of its alliance with the U.S., and impose Islamic law throughout the country.

Pakistan has launched a series of military offensives against the Pakistani Taliban in the northwest along the Afghan border, including in South Waziristan.

Analysts say the operations, combined with hundreds of U.S. drone attacks, have contributed to a significant decline in violence in Pakistan this year.

The number of people killed in suicide attacks in Pakistan in the first 11 months of 2011 dropped almost 40 percent compared to the same period last year, according to data compiled by the Pak Institute for Peace Studies. Deaths from all attacks by Islamist militants fell nearly 20 percent.

GSP overhyped? A Canadian website says so after tough 2011

It's been a lousy year for Georges St-Pierre and he can't even turn to his boys in Canada for a little moral support. Well, it's only one writer's opinion, but Aaron Lefko of Sportsnet.ca included GSP on his "Most Overhyped Athletes of 2011" list.

And even before his injury, St-Pierre was taking verbal shots from the public, the media and fighters for his inability to put away opponents.

He grabbed the international spotlight in April for headlining the first UFC card in Toronto, producing GSP mania. A record UFC crowd of more than 55,000 packed the Rogers Centre to finally see the conquering Canadian hero and he went the full five rounds with Jake Shields in what was more of a clinic on how not to lose a fight than actually win it.

Keep in mind, St-Pierre won the fight against Jake Shields back in April. Since then he's battled injuries all year with the worst coming a few weeks back when he suffered a torn ACL. The fight at UFC 129 is really stuck in the writer's craw.

It was boring at best and continued a pattern of St-Pierre going the full distance without delivering the knockout blow or submission. Heck, the fight before it on the card was way more entertaining than the main event.

We're not exactly sure why it's a bad thing for the undercard to outperform the main event. Plus it seems tough to overhype a guy who's been inactive for eight months.

Check out the rest of the list. Is there anyone on there who's been a champion? Seems a little harsh to put GSP, a legitimate champion, on the list just because he doesn't win the right way.

Is GSP overhyped? Maybe this guy and Nick Diaz are onto something.

Mediterranean diet gives longer life, study suggests

ScienceDaily (Dec. 20, 2011) ? A Mediterranean diet with large amounts of vegetables and fish gives a longer life. This is the unanimous result of four studies to be published by the Sahlgrenska Academy.

Research studies ever since the 1950s have shown that a Mediterranean diet, based on a high consumption of fish and vegetables and a low consumption of animal-based products such as meat and milk, leads to better health.

Study on older people

Scientists at the Sahlgrenska Academy have now studied the effects of a Mediterranean diet on older people in Sweden. They have used a unique study known as the "H70 study" to compare 70-year-olds who eat a Mediterranean diet with others who have eaten more meat and animal products. The H70 study has studied thousands of 70-year-olds in the Gothenburg region for more than 40 years.

Chance of living longer

The results show that those who eat a Mediterranean diet have a 20% higher chance of living longer.

"This means in practice that older people who eat a Mediterranean diet live an estimated 2 3 years longer than those who don't," says Gianluca Tognon, scientist at the Sahlgrenska Academy, University of Gothenburg.

Support from other studies

These results are supported by three further as yet unpublished studies into Mediterranean diets and their health effects: one carried out on people in Denmark, the second on people in northern Sweden, and the third on children.

"The conclusion we can draw from these studies is that there is no doubt that a Mediterranean diet is linked to better health, not only for the elderly but also for youngsters," says Gianluca Tognon.

Gianluca Tognon himself is from Italy, but moved to Sweden and Gothenburg specifically to collaborate with Lauren Lissner's research group at the Sahlgrenska Academy, and develop research into the Mediterranean diet.

When recruiting guests for his long-awaited TM:103 - Hustlerz Ambition, Young Jeezy called upon rap's heaviest hitters. Jay-Z, Snoop Dogg, Lil Wayne, T.I., Andre 3000 and Fabolous all show up for the Snowman's latest LP, which was released in stores on Tuesday. One collaboration, however, stands out among the rest, so if "Trapped" featuring Jill Scott makes you hit the rewind button, don't worry, it was by design.

"I've been doing quote-unquote unusual pairings lately," Scott told MTV News on the red carpet at the "VH1 Divas Celebrates Soul" show on Sunday night. "I've worked with Paul Wall, I've worked with Eve and now with Jeezy."

Scott and Paul Wall's "So Gone" from her The Light of the Sun LP is slow and sultry, while her collaboration with Eve, "Shame," is an upbeat yet soulful affair. Jeezy's J.U.S.T.I.C.E. League-produced "Trapped" takes a drastically different direction.

At the song's open, Scott begins to rap over a building sound bed of lush strings. "Yo they still be grindin' or runnin'/ Tryin' to get into somethin' or nothin'," Scott begins her verse.

Together the Snowman and the soul singer warn against the pitfalls of street business. By the time the drums drop and the full instrumentation takes shape, it becomes crystal clear that Jeezy is once again playing the role of thug motivator. Cautionary but real, Young uses a real-life narrative to illustrate his point. "Gotcha spendin' all your money on lawyer fees/ Judge throwin' numbers at ya like he speakin' Japanese/ All because a n---a out chea playin' bakery/ I'm out chea tryin' get this bread somebody pray for me," he spits in the song's second verse.

It's not unfamiliar territory for Jeezy, who has been mixing street tales with a hustler's sympathy since his debut Let's Get It: Thug Motivation 101. It's just this time out he approached it with a new twist.

"It just made sense in a nonsensical kind of way, like why not? This is music, have fun, stretch it out as much as possible," Scott said. "Jeezy is an MC that I respect. I like his content, that voice is really hard, so yeah, why not?"

Pilots strike forces flight cancellations in Spain

MADRID (AP) ? Spanish airline Iberia canceled a third of its flights Sunday because of a strike by pilots fearing job losses when company planes are diverted for use by Iberia's planned new budget carrier.

Iberia said it scrapped 91 flights, mostly domestic routes, but that no major disruptions were reported at its bustling Madrid hub or other airports because it managed to find alternative seats on other Iberia flights or with other carriers for about 80 percent of the travelers.

Another one-day strike is planned for Dec. 29.

Iberia, Lineas Aereas de Espana, S.A., plans to divert jetliners from money-losing domestic and medium-haul European routes for Iberia Express, which it hopes to launch early next year using lower-earning, newly hired pilots and flight attendants. The company says its plans are for this carrier to have 40 planes in 2015.

Pilots union SEPLA says it ultimately fears job losses among existing staff with the creation of the unit, designed to compete with budget airlines.

Iberia, Spain's flagship carrier, insists that no job cuts are planned among its current 1,600 pilots.

How Rewards Can Make You Hate Something You LoveMany people?including us?have argued that doing what you love and getting paid for it is the holy grail of life achievements, but in reality we tend to get discouraged when presented with the possibility that we're only doing something for the money. Here's why.

According to David McRaney, in his great blog on self-delusion You Are Not So Smart, people who are paid for something they love can kill their passion because they begin to wonder what's motivating them to do the work. He points to a study about children who love to draw that are split up into three groups. One group is told they'll be awarded with a certificate for their drawing, another group is surprised by that certificate when their drawings are completed, and a third group doesn't get anything at all. While you might think the third group feels slighted, the study found that those children simply felt happy to have completed a task they enjoyed. The children who knew a reward was coming, however, were not quite so happy because they'd questioned their motivation:

As Lepper, Greene and Nisbett [the creators of the study] wrote, "engagement in an activity of initial interest under conditions that make salient to the person the instrumentality of engagement in that activity as a means to some ulterior end may lead to decrements in subsequent, intrinsic interest in the activity." In other words, if you are offered a reward to do something you love and then agree, you will later question whether you continue to do it for love or for the reward.

What's most interesting, however, is that the children who received a reward as a surprise were happiest of all. They felt rewarded for their competence, not simply for completing a task. It's these sorts of rewards that actually make us feel good about what we do rather than die a little inside every time we get a bonus based on our performance.

Arabs may take Syria peace plan to United Nations (Reuters)

BEIRUT (Reuters) ? Arab states may take their proposals for ending Syria's crackdown on protests to the U.N. Security Council next week unless Damascus agrees to implement the initiative, Qatar's foreign minister said on Saturday.

Expressing frustration that Syria had not carried out the plan, six weeks after it was first agreed, Sheikh Hamad bin Jassim al-Thani said the window for an Arab solution to the crisis was closing.

"If this matter is not solved in the weeks ahead, or couple of months, it will no longer be in Arab control," he told journalists after an Arab ministerial committee meeting in Qatar. "That is what we told the Syrians from the beginning."

Arab ministers would vote on Wednesday on whether to ask the Security Council to approve the initiative. "I believe that December 21 will be decisive, and we hope that the brothers in Syria will sign (the deal) before this date," Sheikh Hamad said.

Syria has conditionally approved a plan to send monitors to oversee implementation of the November 2 Arab League initiative, which calls on Assad to withdraw the army from urban areas, release political prisoners and hold talks with opponents.

But Arab League Secretary-General Nabil Elaraby said Damascus was objecting to the League's call for protection of Syrian civilians, saying members of the security forces were also being killed in the turmoil.

The United Nations says Assad's crackdown on the protests, inspired by uprisings across the Arab world this year, has killed more than 5,000 people. Authorities blame armed gangs for the violence and say 1,100 soldiers and police have been killed.

The Arab League suspended Syria and declared economic sanctions against Damascus over its failure to implement the initiative, joining the United States, European Union and neighbouring Turkey who have also imposed sanctions.

Long-time Syrian ally and arms supplier Russia took a step closer to the Western position on Thursday when it presented a surprise draft resolution at the United Nations which stepped up its criticism of the bloodshed in Syria.

Sheikh Hamad said that, in response to Moscow's move, the Arab League would meet on Wednesday to decide whether "to ask the Security Council to adopt the Arab initiative and Arab resolutions instead of resolutions from other states."

"We are not talking about military action but we will ask the Security Council to adopt the Arab initiative," Sheikh Hamad said, adding Syria should take heed of events in the Arab world where three leaders have been overthrown this year.

"Procrastination and banking on things quieting down or being controlled by security methods will not work," he said.

Any referral of the Arab plan to the United Nations would be likely to anger Damascus, which has accused unnamed Arab countries of trying to set the stage for foreign intervention.

GROWING INSURGENCY

The unrest is the most serious challenge to the 11-year rule of Assad, 46, whose family is from the minority Alawite sect - an offshoot of Shi'ite Islam - and has dominated majority Sunni Muslim Syria since 1970.

An armed insurgency has begun to eclipse civilian protests, raising fears Syria could descend into civil war.

Two days ago army deserters killed 27 soldiers and security personnel in the southern province of Deraa, an activist group said. On Saturday, activists said, at least 10 people were killed, most of them in Deraa in clashes between security forces and army rebels.

A delegation from Shi'ite-led Iraq, which opposed the Arab League sanctions and fears unrest in Syria will spill across the border and upset its own delicate sectarian balance, stopped in Damascus on Saturday before travelling on to Cairo.

Assad met the Iraqi delegation, which included National Security Adviser Faleh al-Fayad, and "affirmed that Syria dealt positively with all proposals submitted to it," the official news agency SANA reported.

"The delegation will present details of the Iraqi initiative to League officials on solving the Syrian crisis after positive discussions which we had with President Bashar al-Assad during our visit to Syria," a member of the team said on arrival in the Egyptian capital, the Arab League headquarters.

Prime Minister Nuri al-Maliki's media adviser, Ali al-Moussawi, earlier told Reuters in Baghdad that the meeting in Damascus was "very good."

The main exile opposition Syrian National Council was meeting in Tunisia on the first anniversary of the self-immolation of a jobless Tunisian graduate Mohamed Bouazizi, the incident that set off a wave of revolts around the Arab world.

Syrian protesters have expressed growing frustration that the Arab League, which surprised many when it suspended Syria and subsequently announced sanctions against Damascus, has since then extended the deadline for Syrian compliance several times.

Hundreds of thousands demonstrated on Friday, according to the opposition Syrian Observatory for Human Rights, under the slogan of "The Arab League is killing us."

'Memogate': New Pakistan scandal sets alight old tensions

Since assuming the presidency in Pakistan three years ago, Asif Ali Zardari has been hit with allegations of poor governance and corruption, watched his coalition government fall apart and has even seen his health falter. But this latest challenge, in the form of a Supreme Court inquiry into a political scandal dubbed "Memogate" by Pakistan's media, is testing Zardari's hold on power and has put his civilian government squarely at odds with the military establishment once again.

The court's investigation is centered on what -- if anything -- Zardari knew about a secret memo passed to U.S. officials after the May raid on Osama bin Laden's compound. The memo's existence was revealed by American-born, Pakistan-origin businessman Mansoor Ijaz in an October piece in The Financial Times. The eventually leaked contents of the memo -- requesting U.S. help to rein in Pakistan's military and intelligence in exchange for heavy American influence over national security deicsion in Pakistan -- "infuriated many in the armed forces," according to a senior military officer. "It will have a significant bearing on the political scenario if proven true."

The scandal has already forced the resignation of one senior Pakistani official -- then-ambassador to Washington, Hussain Haqqani -- who had played a crucial role in steadying the turbulent relations between America and Pakistan over the last few years, and now threatens to further destabilize Zardari's already-weak government.

Pakistan's military and its civilian government have a history of deep-seated tensions -- which occasionally boil over into full-blown coups -- dating back to the 1950s, when political parties began their struggle for supremacy in the early days of the country's independence. Zardari has himself felt the ire of the all-powerful army, once for attempting to bring the military's intelligence agency -- the ISI?-- under civilian control, and again for pledging to dispatch the ISI chief to India after the November 2008 Mumbai attacks. Both times, his efforts were thwarted by the military. The government's distrust for the military and the military's disdain for the government provide the backdrop for every national crisis, of which there have been many this year alone.

Getting to the bottom of the Memogate scandal will not be easy. The case is already clouded with political motivation (it first brought to the Supreme Court by the leader of an opposition party, bent on dislodging Zardari from power), and every word of submitted testimony is first being parsed by the Pakistani press, then pieced together into wild speculation about legal conclusions.

Legal experts in Pakistan have offered a range of possible outcomes -- including Zardari being forced to resign, or being tried for treason, or his entire government collapsing. And while there is no firm timeline for proceedings beyond the first hearing on Monday, there is already, in much of the reporting, an assumption that such a memo could not have been drafted without the involvement of Zardari.

Despite a visit from?Army Chief Gen. Ashfaq Parvez Kayani to Prime Minister Yousuf Raza Gilani's house today, after which a statement was released urging that military testimony in the case "not be misconstrued as a standoff between the Army and the government," the depositions given by Kayani and ISI chief Gen. Ahmed Shuja Pasha this week are certainly not helping the government's case.

Pasha, who met with Pakistani-American businessman and "Memogate" scandal-blower Mansoor Ijaz in London to review relevant evidence, testified that he believed the memo to be genuine and that Haqqani was involved. Kayani said in his testimony that the memo had already had "an impact on the national security," that there was "nothing denying the fact that the memo exists," and called for a swift and thorough investigation. Both statements, firmly stating that the memo exists, and that this issue needs to be looked into, fly in the face of previous government statements, denying the existence of the memo and dismissing the calls for inquiries as politically motivated.

U.S. Gen. Jim Jones, former national security adviser who acted as American conduit for the now-infamous memo, today submitted testimony that seemed to throw the government a lifeline, saying he had no reason to believe former Ambassador Haqqani was involved and that he did not believe the document to be credible.

Ijaz, the businessman at the heart of this controversy, also submitted testimony. The crucial deposition from President Zardari, however, has yet to surface. Zardari remains under doctor's care in Dubai, recovering from heart-related illness that forced a quick departure from Islamabad last week. He was scheduled to testify yesterday, and there is no word yet on when he will submit his side of the story.

California DUI deaths drop to record low

The number of alcohol-related fatalities on California highways dropped to a record low last year, with the biggest single-year drop in DUI deaths in 14 years, according to a federal report released Tuesday.

The drop was largely attributable to federally funded anti-drunk driving campaigns, the National Highway Traffic Safety Administration said.

Alcohol contributed to 791 deaths in the state in 2010, a nearly 17% decline from the 950 deaths in 2009.

"Education is the key thing we use to inform the public about the reality and dangers of drunk driving," said Officer Mike Harris, a public information officer for the California Highway Patrol. "We develop programs and different awareness campaigns. Put all those things together and it's bound to have an impact."

Trends show that DUI deaths in the state increased annually from 1998 to 2005 but have decreased every year since then.

Officials attribute the recent sharp decline to an increase in the number of DUI checkpoints, a practice that allow police to stop cars in designated areas in search of drivers under the influence.

In 2010, the federal government beefed up the budget for drunk driving checkpoints. The Office of Traffic Safety allocated $16.8 million in federal funds to law enforcement agencies to conduct 2,553 DUI checkpoints last year, up from the $11.7 million allocated for 1,740 checkpoints in 2009.

In Costa Mesa, police are moving away from DUI checkpoints and toward saturation patrols, which target impaired drivers, both as a cost-saving measure and because of direction from the City Council.

Saturation patrols require half as many police officers as checkpoints and allow officers to respond to emergency calls at other locations. Councilwoman Wendy Leece said it's a better fit for the recently reduced Police Department.

Chief Tom Gazsi said saturation patrols are more effective for catching drunk drivers, whereas checkpoints are more of an educational service.

Officials said the state endorses many tactics to combat drunk driving, including saturation patrol. However, it prefers DUI checkpoints because of the high deterrence rate, said Chris Cochran, a spokesman for the California Office of Traffic Safety.

"Saturation patrols arrest more drunk drivers," Cochran said. "DUI checkpoints save more lives. Our end product is to save lives."

Riley: Heat coach Spoelstra gets new contract

(AP) ? Erik Spoelstra and the Miami Heat have agreed on a contract extension, ending any speculation that Pat Riley's protege would be a lame-duck coach this season.

Riley, the team president, made the announcement Friday. The Heat typically does not release terms of deals for coaches and executives, and Riley did not divulge any details of Spoelstra's new deal. Spoelstra is beginning his fourth season as coach and his 17th season with the team overall.

"We have one of the great young coaches in the league, an absolute member of this family and has been for a long time, so we want him to become a Hall of Famer," Riley said Friday. "So it's been taken care of."

The 41-year-old Spoelstra was not available for immediate comment. The Heat had the day off Friday, and Riley spoke at his annual preseason availability.

Earlier this week, Spoelstra said he did not expect his contract to be a distraction, noting that Riley and the Arison family have never given him any reason to be worried about his status with the organization.

"It's a family here," Spoelstra said, "and I'm part of that."

In his first three seasons, Spoelstra has gone 148-98 in regular-season games, 18-15 in playoff games. A year ago, he led the Heat to a 58-24 mark and a 14-7 record in the postseason, where Miami lost the NBA finals to Dallas in six games.

"Me and Erik, our relationship will continue to grow," Heat forward LeBron James said this week. "It's much better today than it was the first day of practice last year. We didn't know each other at all. We were still learning each other. We'd seen each other from a distance. I'd seen him coach from the sideline ... he'd seen me play while he was coaching from the sideline. Our relationship is really good right now. I'm happy with where we are right now."

Riley said the team has been working on Spoelstra's deal "for a while."

Spoelstra came to the Heat in 1995, working his way up from the video room. Spoelstra was particularly close to Stan Van Gundy during his stint in Miami. When Van Gundy stepped down in 2005, Riley took over, and Spoelstra became the heir apparent.

When Riley decided in 2008 that his coaching days were over again, he and Heat owner Micky Arison quickly agreed Spoelstra was the right one for the job. Clearly, that hasn't changed.

"I think he's so much more comfortable his own skin," Riley said. "Contrary to what people might think, I am not a helicopter flying over the top of him all the time. I give him tremendous freedom and space, because I trust the fact that he's in there working every day. He is somebody who is very innovative, and he's not afraid to take some risks."

Riley is a regular onlooker at practice, and he and Spoelstra talk just about every day. But Riley insists the coaching is done by Spoelstra and his staff.

"He does a great job on the bench coming out of time-outs and being prepared for things," Riley said. "And I think the experience last year of also being in the finals and going down to the game that meant the difference in your season and going through that and that pain will help him. I think he's grown leaps and bounds, and he's the perfect coach for this team."

The core of Heat players ? James, Chris Bosh, Dwyane Wade, Udonis Haslem, Mario Chalmers, Mike Miller and so on ? are all under contract for several years to come.

Riley thought it was vital to have their coach be in the same position.

"He never would have been a lame-duck coach even though (media) would have made him one," Riley said. "Guy in the last year in his contract, that wasn't the reason why we did it. The reason why we did it is because we wanted to extend him and keep him in the family and not have somebody come in and steal him away from us. I mean that sincerely ... and I think the players feel the same way."

Twisting molecules by brute force: A top-down approach

Molecules that are twisted are ubiquitous in nature, and have important consequences in biology, chemistry, physics and medicine. Some molecules have unique and technologically useful optical properties; the medicinal properties of drugs depend on the direction of the twist; and within us ? think of the double helix ? twisted DNA can interact with different proteins.

This twisting is called chirality and researchers at Case Western Reserve University have found they can use a macroscopic brute force to impose and induce a twist in an otherwise non-chiral molecule.

Their new "top-down" approach is described in the Dec. 2 issue of Physical Review Letters.

"The key is that we used a macroscopic force to create chirality down to the molecular level," said Charles Rosenblatt, professor of physics at Case Western Reserve and the senior author on the paper. Rosenblatt started the research with no application in mind. He simply wanted to see if it could be done ? essentially scientific acrobatics.

But, he points out, since antiquity chirality has played a role in health, energy, technology and more ? but until now, chirality always has been a bottom-up phenomenon. This new top-down approach, if it can be scaled up, could lead to custom designed chirality - and therefore desired properties - in all kinds of things.

Rosenblatt worked with post-doctoral researcher Rajratan Basu, graduate student Joel S. Pendery, and professor Rolfe G. Petschek, of the physics department at Case Western Reserve, and Chemistry Professor Robert P. Lemieux of Queen's University, Kingston, Ontario.

Chirality isn't as simple as a twist in a material. More precisely, a chiral object can't be superimposed on its mirror image. In a "thought experiment", if one's hand can pass through a mirror (like Alice Through the Looking Glass), the hand cannot be rotated so that it matches its mirror image. Therefore one's hand is chiral.

Depending on the twist, scientists define chiral objects as left-handed and right-handed. Objects that can superimpose themselves on their mirror image, such as a wine goblet, are not chiral.

In optics, chiral molecules rotate the polarization of light ? the direction depends on whether the molecules are left-handed or right-handed. Liquid crystal computer and television screen manufacturers take advantage of this property to enable you to clearly see images from an angle.

In the drug industry, chirality is crucial.

Two drugs with the identical chemical formula have different uses. Dextromethorphan, which is right-handed, is a cough syrup and levomethorphan, which is lefthanded, is a narcotic painkiller.

The reason for the different effects? The drugs interact differently with biomolecules inside us, depending on the biomolecules' chirality.

After meeting with Lemieux at a conference, the researchers invented a method to create chirality in a liquid crystal at the molecular level.

They treated two glass slides so that cigar-shaped liquid crystal molecules would align along a particular direction. They then created a thin cell with the slides, but rotated the two alignment directions by approximately a 20 degree angle.

The 20-degree difference caused the molecules' orientation to undergo a right-handed helical rotation, like a standard screw, from one side to the other. This is the imposed chiral twist.

The twist, however, is like a tightened spring and costs energy to maintain. To reduce this cost, some of the naturally left-handed molecules in the crystal became right-handed. That's because, inherently, right-handed molecules give rise to a macroscopic right-handed twist, Rosenblatt explained. This shift of molecules from left-handed to right-handed is the induced chirality.

Although the law of entropy suggests there would be nearly identical numbers of left-handed and right-handed molecules, in order to keep total energy cost at a minimum, the right-handed molecules outnumbered the left, he said.

To test for chirality, the researchers applied an electrical field perpendicular to the molecules. If there were no chirality, there would be nothing to see. If there were chirality, the helical twist would rotate in proportion to the amount of right-handed excess.

They observed a modest rotation, which became larger when they increased the twist.

"The effect was occurring everywhere in the cell, but was strongest at the surface," Rosenblatt said.

Scientists have built chirality into optical materials, electrooptic devices, and more by starting at the molecular level. But the researchers are not aware of other techniques that use a macroscopic force to bring chiralty down to molecules.

The researchers are continuing to investigate ways this can be done.
