Zoning: A Primer for Real Estate Investors
Most jurisdictions in the United States have some form of zoning in place (The City of Houston,Texas is a notable example of one without formal zoning codes).? We as real estate investors need to have a basic understanding of what zoning is, what it regulates and what its components are because zoning can affect so much of what we do.
This article is intended to serve as a basic introduction to zoning.? Each jurisdiction is different and can have very different zoning regulations.? So please check with your local officials if you have specific questions about the zoning where you invest.
Zoning in its simplest form is the regulation of and segregation of land uses.? Zoning rules generally segregate industry from housing for example, by utilizing different zones in which specific land uses are permitted.? Zoning regulates many other items as well, but we will get to that later; zoning does not make any thing happen, it merely restricts and controls.
Zoning arose around the turn of the last century and was finally legitimized by the US Supreme Court in 1926 in Village of Euclid, Ohio v. Ambler Realty Co., 272 U.S. 365.? Since that time, zoning has taken on many shapes and forms across the country.? But all zoning regulations contain two basic parts, a map and text.? Both the map and text are adopted by the local legislative body, such as city council or county commission, just like any other law or ordinance and are generally known collectively as the zoning ordinance.
The zoning map is a map of a jurisdiction on which the various zoning districts have been drawn in.? Most maps will contain a variety of zoning districts, such as several basic residential districts, a couple of commercial and industrial districts, an agricultural district and floodplain districts.? Other districts could include hospital, recreational and parking districts.? An example can be viewed here of my jurisdiction, Memphis, Tennessee (Click on zoning under hide/show layers ? DPD).
The other portion, the text, is where the meat is. ?This is the portion of the zoning ordinance that describes what can be done in those districts depicted on the zoning map. The text portions can be quite small or be a multi-volume work.?
At a minimum, the zoning text will contain:
- Descriptions of each zoning district,
- Definitions of terms used in the text (note these may be different than common dictionary definitions),
- Permitted uses in each zoning district, such as single-family dwellings, apartments, commercial, industrial, etc.,
- Bulk regulations for the district. These are things that regulate the overall density and design of the district and include:
- Minimum lot sizes,
- Setback requirements or the minimum distances structures must be from property lines and street rights of way,
- Building heights,
- Some will also contain clauses on maximum lot coverage or the maximum amount and lot can be covered by all buildings and structures.
- Procedural matters such as who is responsible for enforcement and how the map or text can be changed.
Many zoning codes can also regulate:
- The height, size and placement of signs and billboards
- Historic districts and the use of construction materials and paint colors in those districts.
- Adult entertainment (for fun, read the definitions of this section).

Why should real estate investors care about all of this bureaucratic mumbo jumbo?
Zoning can directly affect your bottom line, that?s why.
At a minimum you want to make sure the use on the property you are investing in is legal.? In other words that it conforms to the zoning ordinance.? Especially if you are a buy and hold person like me.
If you plan to develop, build or add on to a property you need to know what the zoning ordinance allows.? Can you build what you thought you could build?? Can you add on that third dwelling unit in the back?? Do not trust the seller or the realtor here.? Zoning can be complicated and many times people are simply misinformed.? Check for yourself.
Once you buy it, no matter who did what in the past, the problem is all yours if there is one.? Remember that zoning is not something to be taken lightly or ignored.? They can and will make you tear a building down, stop the use or remove the addition if it does not conform.
Do not think that just because the use has been there forever that it is legal.? Also, do not confuse a property assessor?s commercial designation for tax purposes with the actual zoning designation.? Commercial for tax purposes may not be commercial for zoning purposes.

In closing, remember these points.? Zoning directly affects the value of land.? Commercial or industrial land is much more valuable than land zoned for five acre single family residential lots.? Zoning is also political.?? Politicians sensitive to the political winds will decide what you can do with your private property.? In this respect zoning can really dampen real estate investment or it can encourage it, depending on which way the political winds are blowing.
Finally, zoning can be changed by the local governing body at any time often with little notice.? Keep in tune to what is going on.? It seems that every ten years or so bureaucrats get an urge to ?update? the codes.? Watch this process carefully and protect your interests.

Seattle reaches police reform deal with government
SEATTLE (Reuters) - Seattle officials and the Department of Justice reached a sweeping agreement on Friday to refine the use of force by police officers under a plan to be overseen by an independent, court-appointed monitor.
The settlement, which grew out of a federal investigation of the city's police department, will allow the city to avoid a civil rights lawsuit that U.S. officials threatened to bring over complaints of excessive force by officers.
Such a lawsuit would have put Seattle, considered one of the most liberal cities in the nation, among only a handful of municipalities singled out for police misconduct lawsuits by the federal government.
Instead, Seattle police will operate under a far-reaching plan that covers use of force, police stops and work bias.
The city's police were criticized in 2010 for the shooting death of an American-Indian woodcarver who appeared to pose no threat. A Department Of Justice report in December 2011 said Seattle police in the previous two years had displayed a pattern of using excessive force.
The agreement, which followed months of negotiations between city officials and the U.S. government, calls for both sides to jointly select a monitor within 60 days to oversee implementation of the plan.
"Today the real work begins, the agreement we have reached belongs to everyone in Seattle," said U.S. Assistant Attorney General Thomas Perez, head of the Justice Department's civil rights division.
"I come here with a very deep reservoir of optimism."
Seattle Mayor Mike McGinn said he was pleased with the deal. "This city is committed to eliminating bias," he said. "We do have a lot of work ahead of us."
The American Civil Liberties Union of Washington state in 2010 asked the Justice Department to probe Seattle police, citing a half-dozen incidents of excessive force, particularly against minorities. In one case, video showed a Latino man lying prone on the sidewalk when he was kicked, the group said.
FIVE-YEAR TERM
The agreement is expected to last five years, but the city may ask the federal court to terminate it before that date if Seattle's police department have been complying with it for two years, McGinn's office said.
Under the plan, the department will revise its use of force policies and enhance training, reporting and supervision, Justice Department officials said. It will also develop a team that will roll out to probe serious uses of force.
Officials will also create a civilian oversight board called the Community Police Commission. And the police department will provide guidance to officers to prohibit stops of people when officers lack reasonable suspicion.
Talks on a settlement had bogged down over the anticipated costs of implementing a Justice Department proposal, which a city memorandum estimated would run roughly $41 million for the first year alone.
The memorandum had described those expenses, including $18 million to develop and implement training programs and $11 million for new city positions, as "prohibitive."
McGinn declined on Friday to give an exact cost for implementation of the plan, but said he estimates it could be $5 million a year.
The settlement followed voluntary police reform pacts in recent years with several other big cities, including Los Angeles, Cincinnati and Pittsburgh. Several other large municipal police forces remain under federal review.
On Tuesday, U.S. Attorney General Eric Holder placed the New Orleans Police Department, accused of widespread abuses, under the scrutiny of a federal monitor for at least four years.

Sure enough, early Sunday morning, crews erected a screen and took the statue down behind it. On Tuesday, the wall behind the statue came down, too.

Brown University, the late coach's alma mater, said that it's reviewing whether to remove Paterno from the school's athletic hall of fame, too. Paterno, a member of the Ivy League school's class of 1950, was inducted into the hall in 1977. Brown already took his name off an award given annually to the school's top male freshman athlete.

STATE COLLEGE MURAL (HALO ONLY)
A mural titled "Inspiration" including Paterno and Sandusky and other members of the State College community was painted near campus 12 years ago. After Sandusky was charged, his likeness was painted over. After Paterno died, artist Michael Pilato added a halo, to signify his death, not his holiness. After the release of the Freeh Report, he painted over the halo. He added a large blue ribbon, instead, on Paterno's lapel symbolizing support for child abuse victims. Sandusky has been convicted and is awaiting sentencing.

As part of the NCAA's sanctions handed down on Monday, 112 Penn State wins were vacated. Paterno was credited with 111 of those, and reached the Division I record of 409 last Oct. 29 with a win over Illinois. Late the following week, Sandusky was charged, and Paterno was fired in the aftermath.
On Monday, all those wins were erased, along with Paterno's name atop the record books. Officially, he now has 298 victories and former Florida State coach Bobby Bowden holds the top spot in the NCAA record book with 377 major-college wins. Eddie Robinson, who led Grambling to 408 victories, regained the Division I mark.
The NCAA also took back the Gerald Ford Award it gave to Paterno in January 2011. The honor is for someone who has been a lifelong advocate of college athletics.

Kazan sits along the upper "Mother Volga" in Tatarstan, with a stunning white Kremlin built by Ivan the Terrible atop a hill where he could watch the river.
When I was in Kazan during Soviet days, with its mellow streets lined by the remnants of mansions from the 19th century and Lenin's old wooden family home, the city was already the center of Muslim life in the USSR. And its worth even then in oil, gas and military industries was such that Moscow kept Kazan off-limits to almost all foreigners.
But why attend now to this still largely unknown gem? Because when a leading Muslim cleric of Tatarstan was shot dead on July 21 and the head mufti himself was direly wounded by a car bomb, Kazan suddenly announced to the world that al-Qaida was most probably open for business in Central Asia. This is a deadly warning.
It is, in fact, the typical first warning that Islamic radicals, these probably from Chechnya, are determined to establish an Islamic "caliphate," or independent state under the horrors of Sharia law, over what was, in medieval times, the Tatar-Mongols' "Golden Horde."
As Al Jazeera reported this week, the violence "raised fears of the spread of militancy to Russia's heartland."
Both men who were attacked had been publicly critical of the radicals, or Salafists (followers of the ideology of al-Qaida), and had banned Salafist textbooks from Saudi Arabia in Kazan. But while it was not yet proven that the attackers were these radicals -- whom the Americans are still fighting in Afghanistan, and who still loom large in Iraq -- that was the major suspicion. The Kuwaiti Times wrote of the tragedy:
"The rise of Salafism in this oil-rich Volga River province has been fueled by the influx of Muslim clerics from Chechnya and other predominantly Muslim provinces of Russia's Caucasus region, where Islamic insurgency has been raging for years." Last year Chechen separatists "issued a religious decree calling on radical Islamists from the Caucasus to move to the densely populated Volga River region that includes Tatarstan."

-- In Yemen, at the head of the Red Sea and at the bottom of Saudi Arabia (with which Yemenis historically don't get along), al-Qaida, with its frightening black-and-white flag reminiscent of pirates' flags, has taken over whole towns.
-- In Tajikistan, in southern Central Asia north of China and Afghanistan, several high-level assassinations in the last month have given weight to the suspicion that Salafists had targeted that poor, benighted place -- but there is yet no certainty about it.
Ironically, the one country we used to worry about for exporting radical Islam, Iran, went on the record as criticizing the Tatarstan terrorist attacks. It is "a phenomenon against all theological teachings and humanity," the foreign ministry said in its release. Of course, the Salafists are against Iran's Khomeini-style terrorism.
I suspect we are seeing the beginning of a new age of spreading radical Islamism, which will now send its unemployed and restless youths to the ends of the Earth. We had better be ready for anything.

Last week she found a work-at-home site and started researching it. ?I left their site to visit sites that would lead a trained eye to believe someone was investigating them,? she recalls. When Durst checked again a few days later, the site had reappeared. ?I guess they thought they shook me off. People really have no idea how sophisticated these people have gotten,? she says.
Losses can range from a couple hundred dollars for work-at-home programs to $20,000 or more for people who get hooked on worthless business coaching or training materials that rely on pirated, decades-old books, including one Durst got that was originally written by P.T. Barnum.
